This notice is intended to inform you about the processing of your personal data, which we collect, process and use in the course of our business activities, and about the rights to which you are entitled under data protection law.<\/p>

1. Who is responsible for processing my personal data, and who can I contact if I have any questions?<\/strong><\/p>

2. What types of personal data do I process?<\/strong>
For what purposes and on what legal basis is the data processed?<\/strong><\/p>

We process the following categories of personal data:<\/p>

  • Contact details such as first name, surname, title, department, role, business address, business telephone number, business mobile number, business fax number and business email address<\/li>
  • Further information which is necessary for the processing of projects or the fulfilment of contractual obligations, or which we receive from our business partners on a voluntary basis<\/li>
  • Information from publicly available sources, information databases or collected by credit reference agencies<\/li><\/ul>

    Information required as part of a compliance screening or screening based on commercial law provisions (sanctions list screening).
    The personal data relating to you will be processed for the following purposes on the following legal basis:<\/p>

    • Performance (including invoicing) of the contract (and the implementation of pre-contractual measures at your request) on the basis of Article 6(1)(b) of the GDPR. <\/li>
    • Compliance with legal obligations (e.g. arising from commercial or tax law) on the basis of Article 6(1)(c) of the GDPR. <\/li>
    • Direktwerbung und Marktforschung auf Grundlage von Art. 6 Abs. 1 lit. f) DS-GVO bzw. bei Telefonwerbung auf Grundlage einer Einwilligung gem\u00e4\u00df Art. 6 Abs. 1 lit. a) DS-GVO.     • Processing on the basis of Article 6(1)(f) of the GDPR may only take place insofar as this is necessary to safeguard our legitimate interests or those of third parties, and does not override the interests or fundamental rights and freedoms of the data subject which require the protection of personal data. <\/li>
    • In this context, personal data collected by the credit reference agency relating to the application for, performance of and termination of the contractual relationship, as well as data concerning non-contractual or fraudulent behaviour, will be transferred.<\/li>
    • The exchange of data with the credit reference agency also serves to fulfil statutory obligations to carry out creditworthiness checks (Sections 505a and 506 of the Civil Code).<\/li>
    • The credit reference agency processes the data it receives and also uses it for profiling (scoring) purposes, in order to provide third parties with information for assessing your creditworthiness. Your address details, amongst other things, are taken into account when calculating your creditworthiness. <\/li><\/ul>

      3. Is my personal data disclosed to other recipients?<\/strong><\/p>

      Henze BNP AG works with data processors (e.g. external IT service providers). These parties operate solely on the instructions of Henze BNP AG and are contractually obliged to comply with the applicable data protection requirements. <\/p>

      Personal data will only be disclosed to courts, supervisory authorities or law firms \u2013 insofar as this is legally required and permissible \u2013 for the purposes of complying with applicable law and enforcing legal claims.<\/p>

      4. Is my personal data transferred to or within third countries?<\/strong><\/p>

      Your personal data will not be transferred to or within third countries or to international organisations.<\/p>

      5. How long will my personal data be stored for?<\/strong><\/p>

      Personal data will be stored for the purposes set out in section 2 for as long as is necessary to fulfil those purposes. For the purposes of direct marketing and market research, your personal data will be stored for as long as our company has an overriding legitimate interest in processing it in accordance with the relevant legal provisions, but for no longer than two years after the end of the contract. <\/p>

      6. What rights do I have regarding the processing of my personal data?<\/strong><\/p>

      In particular, you have the following rights in relation to your personal data:<\/p>

      • Right of access to your stored personal data (Article 15 of the GDPR),<\/li>
      • Right to rectification if the data stored about you is inaccurate, out of date or otherwise incorrect (Article 16 of the GDPR),<\/li>
      • Right to erasure where the storage is unlawful, the purpose of the processing has been fulfilled and the storage is therefore no longer necessary, or where you have withdrawn your consent to the processing of certain personal data (Article 17 of the GDPR),<\/li>

      • The right to withdraw consent once given, whereby such withdrawal does not affect the lawfulness of processing carried out on the basis of that consent up to that point (Article 7(3) of the GDPR) and<\/li>
      • Right to lodge a complaint with a supervisory authority (Article 77 of the GDPR).<\/li><\/ul>

        Right to object<\/strong><\/p>

        You may object at any time to the processing of your personal data for the purposes of direct marketing and\/or market research, without having to give any reason. Once we have received your objection, we will no longer process your personal data for the purposes of direct marketing and\/or market research, and we will delete the data unless processing is necessary for other purposes (for example, to fulfil the contract). <\/p>

        You may also object at any time to other processing operations that we carry out on the basis of a legitimate interest within the meaning of Article 6(1)(f) of the GDPR, on grounds relating to your particular situation, provided you state those grounds. In the event of a justified objection, we will, as a matter of principle, no longer process the personal data for the purposes in question and will erase the data, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves to establish, exercise or defend legal claims. <\/p>

        The objection must be addressed to the relevant authority mentioned above.<\/p>
